OVERVIEW

Welcome to AVENLO.

AVENLO is a trading name operated by Kjaergaard Designs, a Danish sole proprietorship.

The terms “we”, “us” and “our” refer to AVENLO and Kjaergaard Designs as the operator of the AVENLO store.

AVENLO operates this store and website, including all related information, content, features, tools, products and services provided through the website (collectively, the “Services”).

AVENLO is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them, govern your access to and use of the Services and any purchases made through AVENLO.

By visiting, accessing, interacting with or purchasing through the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not access or use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your jurisdiction of residence or are otherwise legally capable of entering into a binding contract.

You agree that all information you provide to AVENLO, including your name, email address, billing information, payment details and shipping information, is accurate, current and complete.

You are responsible for maintaining the confidentiality and security of any account credentials associated with the Services and for activities carried out using your account.

You must not use the Services for fraudulent, unlawful or unauthorised purposes.

AVENLO reserves the right, to the extent permitted by law, to suspend or restrict access to the Services where we reasonably believe there has been fraud, misuse, unlawful activity or a breach of these Terms.

SECTION 2 – PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, images, specifications, dimensions and other information displayed through the Services are accurate.

However, minor variations may occur.

Colours and appearance may vary depending on your screen, device settings, lighting, manufacturing batch or other factors outside AVENLO’s reasonable control.

Measurements and dimensions may also be subject to reasonable manufacturing tolerances unless expressly stated otherwise.

Product descriptions, specifications, prices, availability and designs may be changed or updated without notice.

We reserve the right to discontinue products or limit product quantities at any time.

Nothing in this section limits your rights where a product is materially different from its description, defective, unsafe or otherwise fails to meet any consumer guarantee that applies under law.

SECTION 3 – PRODUCT USE AND CUSTOMER RESPONSIBILITY

Products must be used only for their intended purpose and in accordance with any instructions, warnings, care information or limitations supplied with the product or displayed through the Services.

To the fullest extent permitted by law, AVENLO is not responsible for loss, damage, injury or other consequences resulting from:

  • misuse or improper use of a product;
  • use for a purpose for which the product was not designed;
  • failure to follow instructions or warnings;
  • modification, alteration or repair by the customer or an unauthorised third party;
  • improper installation or assembly;
  • negligent or reckless use;
  • accidental damage occurring after delivery;
  • normal wear and tear; or
  • continued use of a product after an obvious defect, damage or unsafe condition becomes apparent.

Unless expressly stated otherwise, products sold by AVENLO are ordinary consumer products and are not medical devices or substitutes for professional medical advice, diagnosis or treatment.

Statements relating to comfort, support, posture, sleep, recovery, wellbeing, appearance or similar benefits describe the intended purpose or design of a product and do not guarantee any specific medical, physical, cosmetic or health outcome.

Individual experiences may vary.

If a product causes significant or persistent discomfort or appears unsafe to use, you should discontinue use.

SECTION 4 – ORDERS

Placing an order constitutes an offer to purchase products from AVENLO.

An order is not finally accepted until payment has been successfully processed and AVENLO accepts the order.

AVENLO reserves the right, to the extent permitted by law, to refuse, limit or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • incorrect pricing or product information has been displayed;
  • payment cannot be processed;
  • we reasonably suspect fraud or unauthorised payment activity;
  • delivery to the supplied address is not reasonably possible;
  • an order exceeds reasonable personal-use quantities; or
  • accepting the order would breach applicable law.

If we cancel an order after payment has been received, the amount paid for the cancelled portion of the order will be refunded.

Please review your order carefully before submitting it.

Once an order has entered processing or fulfilment, we may be unable to accommodate a cancellation or amendment request.

Returns and refunds are governed by our separate Returns & Refunds Policy.

SECTION 5 – PRICES, PAYMENTS AND BILLING

Prices, promotions and discounts may change without notice.

The price applicable to your purchase will generally be the price displayed when your order is submitted, subject to the correction of genuine errors as permitted by law.

You agree to provide accurate and complete billing and payment information.

By providing payment information, you represent that you are authorised to use the relevant payment method.

AVENLO may use third-party payment processors to process transactions.

We do not control and are not responsible for the independent operation of banks, card issuers, payment processors or other financial service providers.

Any applicable shipping costs, taxes, duties or other charges will be disclosed where required before completion of the purchase.

SECTION 6 – SHIPPING AND DELIVERY

Delivery dates and shipping timeframes displayed by AVENLO are estimates unless expressly stated otherwise.

While we aim to have orders delivered within the estimated timeframe, delivery times cannot be guaranteed.

Shipping may be affected by circumstances outside our reasonable control, including:

  • carrier delays;
  • customs processing;
  • border inspections;
  • weather;
  • natural disasters;
  • strikes or industrial action;
  • transportation disruption;
  • public holidays;
  • incorrect or incomplete delivery information supplied by the customer;
  • government action; or
  • other events beyond our reasonable control.

To the fullest extent permitted by law, AVENLO will not be liable for losses arising solely from delays caused by circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

AVENLO is not responsible for delivery problems caused by incorrect or incomplete information provided by the customer, except to the extent required by law.

If you believe an order has been lost, significantly delayed or incorrectly delivered, please contact us so that we can investigate the matter.

Nothing in this section limits any rights you may have under applicable consumer law where goods are not supplied within the legally required timeframe.

SECTION 7 – RISK AFTER DELIVERY

You are responsible for the reasonable care and safe use of products after they have been successfully delivered to you.

AVENLO is not responsible, to the fullest extent permitted by law, for loss, theft, deterioration, misuse or accidental damage occurring after successful delivery where such loss or damage is not caused by a defect or other breach for which AVENLO is legally responsible.

SECTION 8 – RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, replacements and cancellations are governed by our separate Returns & Refunds Policy, which forms part of these Terms.

AVENLO does not voluntarily provide returns, exchanges or refunds for change of mind unless expressly stated otherwise.

This does not affect any rights or remedies that cannot legally be excluded.

SECTION 9 – INTELLECTUAL PROPERTY

The Services and their contents, including without limitation AVENLO branding, logos, graphics, text, website design, photographs, videos, product presentation, marketing materials and other content, are owned by or licensed to AVENLO unless otherwise stated.

They are protected by applicable intellectual property laws.

You may use the Services solely for personal and lawful purposes.

Without prior written permission, you must not reproduce, copy, modify, distribute, republish, commercially exploit, scrape or otherwise use AVENLO content except where permitted by law.

AVENLO names, logos, designs and slogans may not be used in a manner that suggests endorsement, affiliation or ownership without permission.

All third-party trademarks remain the property of their respective owners.

SECTION 10 – OPTIONAL AND THIRD-PARTY TOOLS

The Services may provide access to tools, integrations, applications or functionality operated by third parties.

AVENLO does not control such third-party services and does not guarantee their availability, accuracy, reliability or suitability.

Your use of third-party tools may be subject to separate terms and privacy policies.

To the fullest extent permitted by law, AVENLO is not responsible for losses arising solely from the independent actions, failures or services of third-party providers that are outside AVENLO’s reasonable control.

SECTION 11 – THIRD-PARTY LINKS

The Services may contain links to third-party websites or platforms.

These links are provided for convenience and do not necessarily constitute endorsement.

AVENLO does not control third-party websites and is not responsible for their content, security, availability, products, services or privacy practices.

Any transaction entered into directly with a third party is between you and that third party.

You should review the applicable terms and policies before using third-party websites or services.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

AVENLO is powered by Shopify, which enables us to provide the Services to you.

However, any sale or purchase made through the AVENLO store is made directly between you and AVENLO.

Shopify is not the seller of products purchased from AVENLO.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses, damage or liabilities arising solely from products sold directly by AVENLO.

Nothing in this section limits any rights that cannot legally be excluded.

SECTION 13 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, which forms part of these Terms.

AVENLO is operated by Kjaergaard Designs, which is responsible for the processing of personal information where required by applicable data protection law.

Because Kjaergaard Designs is established in Denmark, certain processing of personal information may be subject to the General Data Protection Regulation (GDPR) and other applicable European and Danish data protection laws.

Our Privacy Policy provides further information regarding how personal information is collected, used, stored and disclosed, the legal bases relied upon where applicable, your rights in relation to your personal information, and how to contact us regarding privacy matters.

Because the Services are hosted by Shopify and use third-party service providers, certain personal information may also be processed by Shopify and other third parties in accordance with their respective privacy policies.

Please review our Privacy Policy for full details regarding the processing of personal information.

SECTION 14 – FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily submit feedback, reviews, photographs, suggestions, ideas or other content to AVENLO, you grant AVENLO a non-exclusive, worldwide, royalty-free right to use, reproduce, display and distribute that content for legitimate business and promotional purposes, subject to applicable privacy and consumer law.

You represent that you have the necessary rights to submit any content you provide.

You must not submit content that:

  • infringes another person's rights;
  • is unlawful;
  • is fraudulent or knowingly misleading;
  • contains malicious software;
  • impersonates another person; or
  • is otherwise prohibited by law.

AVENLO reserves the right to remove unlawful or inappropriate content where permitted by law.

SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS

From time to time, information on the Services may contain genuine typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, promotions, shipping costs or estimated delivery times.

To the extent permitted by law, AVENLO may correct such errors or update information at any time.

Where a genuine and obvious error materially affects an order, AVENLO may cancel the affected order and provide a refund of any amount paid.

Nothing in this section permits AVENLO to engage in misleading or deceptive conduct or removes any mandatory consumer rights.

SECTION 16 – PROHIBITED USES

You may only use the Services for lawful purposes.

You must not use or attempt to use the Services to:

  • commit fraud or unlawful activity;
  • infringe intellectual property rights;
  • harass, threaten or harm others;
  • transmit malicious software;
  • obtain unauthorised access to systems or information;
  • interfere with the security or operation of the Services;
  • collect personal information about others without authority;
  • send spam or unsolicited communications;
  • impersonate another person or entity;
  • make fraudulent purchases or payment claims;
  • manipulate reviews or feedback;
  • scrape or systematically extract website content without authorisation; or
  • circumvent technical protections or access restrictions.

AVENLO may restrict or terminate access where we reasonably believe these Terms have been violated.

SECTION 17 – NO GUARANTEE OF PARTICULAR RESULTS

Unless expressly required by law or specifically guaranteed by AVENLO in writing, we do not guarantee that:

  • a product will produce a particular personal result;
  • a product will meet every individual preference or expectation;
  • a product will provide a particular level of comfort;
  • a product will improve a medical or health condition;
  • use of a product will produce identical results for different customers; or
  • information provided through the Services will be suitable for every individual circumstance.

Testimonials, customer reviews, photographs and descriptions of individual experiences do not constitute guarantees that another customer will achieve the same result.

SECTION 18 – DISCLAIMER AND LIMITATION OF LIABILITY

THIS SECTION IS INTENDED TO LIMIT AVENLO’S LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Except for rights, guarantees, remedies or liabilities that cannot lawfully be excluded or limited, the Services and products are provided without any additional warranties or guarantees beyond those expressly provided by AVENLO.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AVENLO, ITS OWNER, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, SERVICE PROVIDERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, PRODUCTS OR THESE TERMS.

This includes, to the fullest extent permitted by law, loss arising from:

  • misuse or improper use of a product;
  • failure to follow instructions or warnings;
  • use of a product for an unintended purpose;
  • modification or alteration after delivery;
  • accidental damage occurring after delivery;
  • normal wear and tear;
  • incompatibility with a customer's individual circumstances where no contrary representation was made;
  • failure to achieve a particular personal, comfort, cosmetic, sleep, lifestyle, health or other subjective result;
  • interruption or unavailability of the website;
  • third-party websites, tools, payment providers or platforms;
  • carrier or customs delays outside AVENLO’s reasonable control;
  • acts or omissions of third parties outside AVENLO’s reasonable control;
  • loss of data;
  • loss of profits;
  • loss of revenue;
  • loss of business opportunity; or
  • other consequential or indirect economic loss.

To the fullest extent permitted by law, AVENLO does not accept liability for injury, property damage, loss or other damage caused by misuse, improper installation, alteration, negligent use, failure to follow instructions or warnings, or use of a product contrary to its intended purpose.

Where applicable law permits liability to be limited but not completely excluded, AVENLO’s liability shall be limited to the maximum extent permitted by that law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified, including any applicable rights under the Australian Consumer Law.

For the avoidance of doubt, AVENLO does not attempt through these Terms to exclude liability where doing so would be unlawful.

SECTION 19 – AUSTRALIAN CONSUMER RIGHTS

Where the Australian Consumer Law applies to your purchase, you have consumer guarantees that cannot be excluded by these Terms.

These may include guarantees relating to acceptable quality, safety, fitness for disclosed purpose and conformity with product descriptions.

Nothing in these Terms or any other AVENLO policy is intended to remove those rights.

Where a product fails to comply with an applicable consumer guarantee, the remedies available will depend on the nature and seriousness of the failure and the requirements of applicable law.

These rights exist in addition to any voluntary rights AVENLO provides.

SECTION 20 – INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify AVENLO against reasonable third-party claims, losses or costs arising directly from:

  • your unlawful use of the Services;
  • your intentional or fraudulent breach of these Terms;
  • your infringement of a third party's intellectual property or other rights; or
  • your unlawful misuse of AVENLO products.

This indemnity does not apply to the extent that the relevant loss was caused by AVENLO or where such an indemnity would be prohibited or unenforceable under applicable law.

SECTION 21 – TERMINATION

AVENLO may suspend or terminate access to the Services where reasonably necessary, including where there has been fraud, unlawful conduct, security abuse or a material breach of these Terms.

Termination does not affect rights or obligations that arose before termination.

Provisions which by their nature are intended to survive termination will continue to apply, including provisions concerning intellectual property, liability, indemnification and governing law.

SECTION 22 – FORCE MAJEURE

To the fullest extent permitted by law, AVENLO will not be responsible for delay or failure to perform an obligation where that delay or failure is caused by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, war, civil unrest, government action, border restrictions, customs delays, transportation disruption, labour disputes, telecommunications failures, widespread technology failures or similar events.

This section does not remove rights that cannot lawfully be excluded.

SECTION 23 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.

If this is not possible, the affected provision will be severed.

The remaining provisions will continue in full force and effect.

SECTION 24 – WAIVER AND ENTIRE AGREEMENT

A failure by AVENLO to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with policies expressly incorporated by reference, constitute the agreement governing your use of the Services.

Nothing in this section excludes representations or rights that cannot legally be excluded.

SECTION 25 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.

AVENLO may transfer its rights or obligations in connection with a legitimate sale, restructuring or transfer of the business, provided that doing so does not unlawfully reduce your existing consumer rights.

SECTION 26 – GOVERNING LAW

To the extent permitted by applicable law, these Terms and purchases made through the Services are governed by the laws of Australia and, where applicable, the laws of the Australian State or Territory relevant to the transaction.

Nothing in this section excludes, restricts or modifies any mandatory consumer protection law or other mandatory legal right that applies to a transaction and cannot lawfully be excluded by agreement.

Where the Australian Consumer Law applies, nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, remedy or liability arising under the Australian Consumer Law that cannot legally be excluded, restricted or modified.

AVENLO's establishment and operation from Denmark may also make AVENLO subject to mandatory Danish or European laws relating to its business activities. Nothing in this section is intended to exclude any such law where it applies regardless of contractual choice of law.

SECTION 27 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices, technology or applicable law.

The current version will be published on this page together with the date of the latest update.

Where required by applicable law, material changes will not be applied retrospectively and appropriate notice will be provided.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
